Doubt regarding year of manufacture and CMVR Cirtificate date

On 3/3/2009 I have brought a  Petrol car through a dealer in Kochi, Kerala india.

In the sale certificate (Form 21) the dealer mentioned that the year of manufacture is January 2009. But the date of Road worthiness certificate in Form 22 issued from the manufacturer  is 24/6/2008. (CMVR cirtificate NO: AADN/0029, dated 21st February 2008) (Also note that the CMVR certificate issued is with Engine number and chassis number).

My doubt is that is it possible to have a vehicle manufactured in Jan 2009 with a CMVR certificate issued on 24th June 2008?. That is, is it technically possible to issue the CMVR certificate by  the manufacturer before manufacturing the vehicle. 

Also while purchasing the vehicle I have insisted for 2009 make (even though they have offered some discounts like rear park sensor for 2008 models) to get a fresh piece. 

Please assist me to find out whether the dealer modified the sales certificate to make me believe that the vehicle is 2009 model or the above situation is normal.

The car appears to be 2008 model in all probability.

Have you registered the car? Make date will be printed there. And have a look at the labels attached in some accessories like seat belt for the date of manufacture.

Do mention the name of dealer and brand so that other members will take care while purchasing.

My Vehicle is Skoda Fabia 1.2 Ambiente petrol and Dealer is Marikar Engineers Limited, Kochi/Kerala

I have done a research regarding the year of manufacture.

Fortunately, all  Skoda / volksWagen Vehicle will have a Vehicle Identification number (VIN) - Here in India it is the Chassis number. By decoding it we can find out the vehicle details.

For decoding VIN/ Chassis Number you can use the website

The result of my vehicle's VIN code is

Škoda Fabia II Ambiente 1.2 HTP 51kw

model year 2008, production number 504695

production plant Aurangabad

The entered VIN is valid!

"

That is my behicle is a 2008 model.

Now it is clear that I have been cheated by the dealer.

Can anybody provide some legal advice?

It is really a bad situation. Have been hearing many bad news regarding pathetic service of Skoda dealers.

Please go through the discussions started by other members also cheated in similar manner by some dealers,

Before seeking the legal course, I prefer you take up the issue with owners of Marikar motors and subsequently with Skoda India top brass. If it does not resolve, seeking media attention will also help.

Writing a stern mail to skoda (maybe all these bigwigs in cc, wot u say Feroz?) regarding the cheating by the dealer, along with attachments of the certificate scans will probably do the trick, as someone from Pune had written that the Skoda guys are quite responsive. Also mention that if in 15 days, this matter is not resolved to your satisfaction, you would launch a complaint to consumer court.

PS: Keep the return receipts and delivery proofs of the mail.

I have contacted M/s Skoda auto India (P) Ltd for the confirmation regarding the manufacturing date and they have confirmed that the vehicle is manufactured in June 2008 and invoiced to M/s Marikkar Engineers (P) Ltd/Kerala on 28/12/2008.

With the above facts I have contacted the dealer M/s Marikkar Engineers (P) Ltd/Kerala and they too admitted the discrepancy and asked me the kind of compensation that I am looking for?

Can any body suggest a descent compensation that I can demand from the dealer?

[Note: My complaint: The dealer delivered a 2008 model vehicle with a forged sales certificate indicating it as a 2009 model.]

This is very unfortunate-but then reconfirms the hopeless attitude of the Dealers. With Skoda already dragged to court by HarishV this episode seems to r strengthen the need for chnage from Skoda. Ask them for full free extended warranty and 3 free services along with anti-rust and teflon coating.

Besides, you should be paying price of the car as it was in June 2008.  Demand refund for the difference.
