Selling a 2007 DL registered car in Mumbai

HI!

I have already gone through numerous threads, but still have a few queries.

I have a car that i purchased in Delhi. I have shifted to Mumbai & paid the O.T.T at Andheri RTO. I have not paid any OCTROI charges.

Now I want to sell the car in Mumbai. I have not obtained a NOC from Delhi RTO.

My Questions:

1) Incase the buyer is ready to buy my car without NOC, is it ok to sell it?

2) If not, will obtaining a NOC and then selling it be enough, or do I need to get a MH- number?

For registering the car in Mumbai you must need the NOC from Delhi and will have to Pay Octroi in Mumbai.

Even if the buyer is ready to buy the car without noc it will create problem in future as the car is registered in your name.

(1) If sold without NOC / re-registration in Mumbai, the name transfer will obviously be effected in the Delhi RTO.  It will then be the buyer's responsibility to get it re-registered at Mumbai (you have nothing to worry).

(2) If NOC is obtained & sold - it should first be re-registered in Mumbai in your name (before selling it), as the NOC is issued in your name.  You can sell the car, thereafter.

Normally, buyers would prefer 2 above.

Hi Pankaj, I have a small clarification here. As per (1) if he sells it to buyer without noc and without re-registartion in mumbai:

a. name transfer will be effected only in delhi rto computer database right?

b. The name and address in the RC will be the same as the 1st owners name right?

c. So in case if the vehicle is misused by the new buyer, the responsibility will be the person who is there in the RC book right?

Sorry for the inconvenience, iam just bit curious to know what happens after the vehicle is transfered to new buyers name without re-registering.

On selling it without NOC & re-registering in Mumbai (i.e. with Delhi registration no. itself), the name transfer will have to be effected in the Delhi RTO as well as in the RC Book, and also in the Insurance Policy - concurrently within 14 days.  For the purpose, relevant papers, documents etc. will have to be sent to Delhi RTO / Insurance Company for endorsements.

Once the name transfer is so effected, the seller is not responsible for any misuse or whatever.

My cousin found out from the Delhi RTO about this.

They say, I need to sign on the FORM 28 (application for noc for transter/sale). This form will need to have the details of the BUYER, ie his name & address.

I will need to give this FORM duly filled and signed to the BUYER along with the other documents. Also i need to have the insurance transferred to the buyer's name (using the Delivery note, other forms)

Then i send a copy of the TRANSFER FORM to DELHI RTO.

The BUYER then simply has to apply to delhi RTO for the change in NAME & re-regis to MUMBAI.

THIS IS WHAT AN OFFICER AT THE RTO in DELHI has told my cuz.

GUYS DOES THIS PROCEDURE (though it may sound complicated, but is not really) MAKE SENSE???

The form is popularly known as TTO (transfer) form.

The procedure has to be followed.  Ensure that the buyer completes the formalities immediately.  Thereafter, you need not be concerned about the buyer re-registering it in Mumbai.
