Question on NOC taken from Chennai RTO

Hello All,

I had taken a NOC from the Chennai RTO in March'07 when I moved to Bangalore but haven't used it yet. I have been driving under my TN registration without any problems in Bangalore. I have now decided to sell my car in Chennai since I heard that if I re-register the car value goes down considerably.

When I asked a dealer in Chennai he said that since I have the NOC endorsement in my RC book I would need to get a "non-migration certificate" or something of that sort from the Bangalore RTO stating that the car did not come to Bangalore RTO for registration. Has anyone successfully got this kind of a certificate from any RTO in Bangalore or anywhere in India ? If so, please let me know of the procedure.

I don't think you require 'no migration certificate' from Bangalore, as it is evident from RC Book that it has not been transferred/re-registered at all.  In my opinion, you just need to get the NOC obtained cancelled from Chennai RTO.  As I understand, it is not a lengthy process - it involves some paperwork & nominal fee.  Get it done through an agent, as papers move very efficiently through agents - he too may charge nominally.

After the NOC is cancelled, you can sell-off your car in Chennai.

Hi Srinath,

Can u tell me the procedure how u got NOC from the RTO,Chennai. I am planning to get my bike from Chennai to Pune. Is it necessary for me to take NOC as i will be staying here at Pune only for about 1or 1.5 years.Please can u mail me the details to this mail id :

In the meantime, the general know-how/procedure I know is....

Obtaining of NOC is not a complicated procedure - you need to apply / fill up a form requesting for an NOC in favour of Pune RTO. It can be easily obtained through an Agent by paying a nominal fee & charges (things move efficiently through agents in RTOs). You will then require to get your bike re-registered at Pune by paying tax afresh.  You can claim the life time tax, if paid at Chennai, for refund - it will be refunded on pro-rata basis.  This is a time consuming - get it done through an agent & a local (Chennai) friend to follow-up.

However, in your case, as you are to re-locate only for a year or so, you may not obtain NOC / get the bike transferred/re-registered (at Pune).  I think (not sure) there is some provision for the purpose of retaining the same registration in other state/s for 1 year.  In any case, normally transferable people do not get it transferred / re-registered - they conitnue to use the vehicle with the same registration in the new state even for longer periods, and generally there's no problem, as such.

I dont think we need to re-register while moving to a different state in case there is no change in ownership. We could always pay the road tax for that state and continue using our vehicles.

However this may not work for those who are transferred for short durations and that too to multiple locations. And as suggested by Pankaj for such a scenario, there is a 6month to 1 year period which the RTO also keeps in mind before asking for paying the road tax for that state. It is difficult to prove that we are there in the new place for a short duration though as the RTO is bound to believe that we may not be telling the truth. Nothing wrong with them. It's their job to catch tax avoiders.

The RTO officers would also suggest that we keep the papers updated. i.e. new address/contact details on license / registration certificate etc. Ideally this is a good practice. However i dont think there is an insistance on these from the RTO in any of the states.

In many countries when people migrate to a different state, they are asked to get new license / RC from the new state RTO office. This way they have a track of who the right owner is and in many ways this is helpful too.

I am the one using the vehicle. So if i am using it here for short period of time i dont need to take a NOC. Then i should pay road tax etc and keep my papers updated from Chennai RTO is that so?? . Do i have to intimate the Pune RTO regarding this. I have all my papers right even the vehicle insurance updated in chennai.So can i transfer my vehicle without taking NOC and use it here.

Bhusan/Ganesh, what I mean by re-registration is not the change of number but getting it registered by paying tax afresh.  I used the word re-registration because it is getting registered again (other state).  Anyway! Yes, the number doesn’t change, unless you desire to (provision).  You can pay the tax & continue with the same old number. 

 

By the way, in change of ownership within the state, the number doesn’t change – there is no provision for change in number.  It has to be re-registered/ transferred in the name of new owner – and the tax is not to be repaid (it’s tax-prepaid-car).  In case of change in state (buyer from another state), it is re-registered directly in the new name/owner by paying tax of that state (by the buyer) – and the number changes only if the buyer desires to, else he too can continue with the old registration number.

 

Ganesh, as you are relocating only for a year, the practical way out is to keep the tax/papers updated at Chennai RTO itself.  Carry/use the car in Pune without re-registering/paying the tax afresh – as is being done by many transferable people for years without having any problem as such.  Regarding intimating Pune RTO, I suggest if you could gather some information on how much period they permit (provision) the other state vehicles without re-registration/paying tax – if they are permitting for 3 or 6 months, you could conveniently avoid intimating them for the first 3/6 months & do the needful thereafter.

 

If you are caught in the meantime, you will have to ‘manage’, else pay the tax with penalty.  The penalty, as I understand, varies from 20% to 50% of the tax.

I actually brought my bike from Ranchi to Chennai. I got the NOC from Ranchi RTO. Now whats the time limit in which i have to re register my bike. I mean to pay the fresh taxes.

hi.
i am sriram. i just mived into pune a week back and i find it very difficult to commute to work from my place here.. so.. i am planning to get my car transferred from chennai. its a 2005 santro n have done 27 k wid tht.

wats the procedure to get it transferred? n how much will it take for me to complete all the procedures ( like registration, road tax etc. ) excluding the transfer expenses.

or will it be a sensible decision to sell it in chennai and get an used one in pune..

pls post in ur suggestions..

You can take your Santro to Pune and just pay the road tax and drive over there.

I think there might be no problem. My friend is using his Maruti SX4 registered in Tamil Nadu in Kerala
