CAR WITHOUT PAPERS

Hi! All

I bought a Ford Mondeo from a dealer in Chembur , Mumbai two years back for 5.3Lakhs . I paid him all thru the cheque and cash while buying the vehicle he showed me the papers of the car and told me that the same will be handed over to me once the new owner is registered since then i mean from 2 years now i have not received my car papers.Now whenever i call him up he hardly responds to my calls......seems that he has no intentions of giving me my papers....Can you guys please advice me the way out of this problem. I am planning to make the police complaint and file a case against me....

Do you have any document to prove that you purchased the car from that guy? Better drop in at his place and ask for the papers.No offence meant but i dont know why you have delayed such an important matter for 2 whole years? There is another work around for this but a bit lengthy and troublesome. Visit the RTO office and find out on whose name the car is as of now. I dont know if this would be feasible but you could try and contact the earlier owner (if its still in his name) and get the car transferred by a mutual understanding. IF it has been transferred to your name you could get a duplicate copy of the docs.

It is a dangerous situation. The RC book can be used for hypothecation with private financiers for taking loan, and if defaulted, the car you possess will be the security, which they can repossess legally.

So better late than never.. Go in search of the person and transfer the ownership into your name after getting documents.

did you give the seller a DELIVERY NOTE,qouting the price you paid for the car and the date,if you have a copy of it,you can go to the RTO office for a name transfer if you have the RC book,if you dont even have a delivery note,the car is as good as his,i really feel sorry,one has tolearn not to trust every one on earth,the possitive is you have paid THROUGH CHEQUE,so still you can legally claimed that you have made payment for the car,keep us posted,am worried too,only thing you can do now is befreind the seller,plead him for the rc book,confrontaion might not help

Many thanks for your advice , I have the delivery challan from the dealer, in it he had mentioned the car and the payment he received. I have tried all so far achieved nothing i dont have any of the documents but have the xerox copies of it. Today i have filed the case in consumer court too. Lets see what's gonna happen next....Will definitely keep you posted...

i have seen this in many setions where you have one thread showing up on the main page and once you enter the setion, the thread is no where to be found Thanks for clearing it!
