Pankaj, I did not mean refiling FIR. It is not possible.

The possibility is what ever defects in the FIR can be rectified in the course of investigation. What court considers is the final report on the case.

So if there is a statement by Mr. X about the mentioned fact that will cover the defect in the FIR. But the investigating officer should be helpful for including that statement.

I have purchased a car from broker.  The car has been transferred to my name but the insurance is not transfeered in my name.   In between the car was stollen.   Can I get the insurance claim.   Car is insured till 2010.

Sorry to hear about the theft.

The insurance policy needs to be transferred in the name of the buyer within 14 days from the date vehicle ownership is transferred in the RTO.  If not, the insurance policy (standing in the name of the earlier owner) turns invalid.  Driving such a vehicle is illegal too.

Sir my one month old car alto was stolen. I had a tata aig insurance they are refusing to pay full amount, now bank is after me for repayment suggest me how to fight this cheat insurance company

Please suggest me legal option

sir, i also have  exact same problem. i purchased a second hand car from car resailers . they transferred rc book as for hypothecation purposes but not insurance policy . in mean time before insurance policy expires my vechile was stolen. since insurance was not transferred insurance company is declined the claim. pl help me.

sir , also major issue .since my vechile was stolen and insurance company denied to pay my bankKOTAK MAHINDRA PRIME LTD  without intimating me deposited one cheque and got dishonored to file N-138 case aginse me and even issued me summonce . but before summonce date i repayed full amount and got noc from bank. After 1 year i received non-bailable warrant from banglore court even after rapayment and noc from bank now bank say they have now withdrawn the case nOW CAN I FILE DEFAMATION CASE?

There is nothing to gain by filing defamation suit. Leave it. Once a case is filed in a court, it takes time to close the proceedings. Why waste time and money?
