new cruze screwed...not my fault,.....

Hello 

I bought my cruze in july 10 and about 5 days back while I was on my way home, driving at a steady speed of 30km per hour or so, i could see a young guy driving his beat coming towards me in my side mirror. Without breaking or any prewarning, he straightaway dashed my car from behind. The rear bumper, reverse sensors, the body control unit located to the drivers side behind the fuel tank, the tail lamps and right sided rear metal body parts were gone on the spot. I lodged an FIR and took my vehicle to nearest chevrolet workshop. The young chap is not ready to compensate. The company has given me an estimate of 50-60K which might increase with time. 

Please opine about what all parts from the abovementioned list are covered in standard insurance. Will I get some compensation by filing a lawsuit or lawyers charges will cost me more than the compensation(I have learnt that lawsuits go on and on for many years). 

Is there something called as comprehensive insurance which will cover all parts of the car? In case it is there i will have to go for it after my present insurance validity  expires....

Well I guess the police must have booked that guy for rash & negligent driving...however I am not sure if the offender is entitled to also compensate the damage he caused - as you said it is a court matter.

Anyways, legalities aside, you can get all the things fixed under insurance - however, the compensation that is paid to you by the insurer will be less than the amount you spend, plus there will be certain exclusions also. Check with the insurer to get the exact details of what all is covered/excluded and how much compensation you can expect.

its very sad ,without ones fault one needs to bear all this..

anyway i think insurance can be claimed except for few parts and you will be charged minimum of 4k(as per my experience with MS)

hope you get the compensation .

Bad news Manish !!

since your car is new, you will not end up paying much. 50 % cost of plastic parts & some depriciation is what you will be asked to pay. pls check the insurance co.

I have a question now ( may be I am ignorant) . Wont that Beat guy have  a thrid party / comprehensive cover on his insurance. Why dont the company which insured him give the money rather than Dr.Manish losing his NCB.

Note : When I asked abt third party insurance (for my 10 old car) those guys told me claims came be done for the other damage not own damage.

Legal hassles.....yea it will go on and on and on. Will take few years for sure. The case goes ot MACT (Motorvehicles Accident Claims Tribunal)

If Manish decide to proceed with the case then the Beat's insurance is supposed to pay. Manish stand more chance since its a rear collision. But then it all depends on the cop who prepares the chargesheet. Yes the beat guy is supposed to pay the money either from his pocket or from his insurance. Make sure you lodge a complaint and the complaint is registered. That guy was drunk? Comprehensive or third party beat guy must pay for it. If you manish uses his own insurance it is going to increase his premium for the coming year. The best way is to go for Beat guy's insurance. If you have influence....some contacts, then put pressure on the beat guy and try to make an out of the court settlement.
