Car accident without RC and Inurance transfer

I bought a second hand car and met with an accident the very next day. A thirdparty individual and a commercial vehicle is involved too. I got the RC transfered to my name only after the accident. Can i claim for the car damage? Will there be a problem with the third party claim?

Did you complete formalities such as filing an FIR, intimating Insurance agency about the damage etc? If yes, you can claim the same, however it would be slightly complecated. As far as I understand, the issues will be:

1. Insurance company will issue the cheque in the name of previous owner as the car was insured by him at that moment of time.

2. The seller will lose all his NCB henceforth and you may have to compensate him for this.
