Accident at Service Centre

Hi,

I had given my bike Blaze 2007 model to the Authorised service centre to replace the battery. It was there for about a week. However one fine day, the centre called up to report that a Maruti car has rammed into 4 bikes of the service centre all parked outside the centre premises. Currently one of the bike owners has filed an FIR on and included all 4 bikes in the FIR. My Insurance Surveyer has come and inspected the bike, but mentioned since the bike has fibre/plastic parts insurance refund will be partial. I had the following questions in this scenario:

1) As the accident occured when the bike was in the possession of the service centre, shouldnt they pay for all damages incurred without taking a penny out of my insurance policy (which will increase my premium in future years?)

2)  What about 3rd party insurance from the vehicle owner (who was caught)?

3) What are the other TIPS in this scenario?

1) Claim insurance (whatever) & insist the service station to bear the amount not reimbursable under the claim & also make good for the NCB you may lose in future.

2) You cannot claim 3rd party insurance, as your vehicle is insured.

3) Please note that vehicles are accepted for repairs etc. at owners risk.  Litigation will not help.  Try & get the best possible from the service centre.

One week for replacing a battery? This is a 15 minute task best done at a private battery shop. Dude, you should take better care of your bike. If it is very infrequently used, my suggestion is to sell it off, letting someone else use it more.

I fully agree with Pankaj's assessment of the situation as far as further course of action on the incident is concerned.

Damn, this was the first thought came into my mind when i started reading this thread.

@Carman

Feeling sad for your bike.Never ever go to such workshops who keeps the bike for 1 complete week just for Battery change.

And, what was your bike doing outside the centre premises. Its okay vehicles are accepted for repairs at owners risk.But, that risk is certainly not about the security.

Owners' risk, sadly though, includes security/theft etc. 

I'm only trying to emphasise that in case of dispute or litigation, it's very difficult for us to benefit.  It's better to settle amicably.  Try your best & put all the pressure.

Hey Guys,

Thanks a million for your responses. Actually I do use the bike everyday to travel to work, but after the last battery was replaced(it lasted for about 2 years), I started getting self start problems which became chronic although I visited the service station at least 8 times for the same. Finally they agreed to replace the new battery. However this battery also was not in stock and hence the delay. I had asked the service centre if i can use the bike only on kick start, but they mentioned that this may damage the rectifier, which is not available. So I agreed to keep the bike there until the battery was replaced, I guess that was my mistake . Also Bike service centres are usually small and they park the bikes on the outside. There is an authorised Bajaj service centre adjacent to this Kinetic service centre and they too park most of the service bikes outside.

It is indeed sad that we have to suffer (with or without monitory loss) on account of no mistake of ours.
