Insurance Claim - Car accident with a bus :(

Hi,

I had an accident of my car with a local ghaziabad route bus in noida. I was crossing through sector-62 and the bus driver driving very fast ran through my car from site towards front on 90 degree angle. Bus driver ran away with the bus very fast. My car is severely damaged but I thank god that I am safe.

After the accident, police came, and they took me and my car to thana sector-58, Noida. There, they registered an FIR against the bus and gave me a copy. Now, my car is inside thana sector-58. Police say that car will be technically investigated by their team and then the matter will be sent to the court. After that I can give an application to the court then they will release my car.

If somebody had any such bad experience, please suggest me the process to get my car released first from the Thana and then claiming insurance.

Hi

My brand new (1 month old)  Tata Nano met with an accident in South Ex Phase I Delhi. A rashly driven Toyota Innova coming onto the main road from the side road decided to turn just as I was passing through and completely damaged the rear left side door and the rear fender above the engine.

  I filed a complaint with the police by calling 100 and gave them the particulars of the vehicle and took my car to the workshop to take a look at the damage.

I have a few questions -

1) I just wanted to reconfirm wether it is necessary to file an FIR or will the complaint to 100 be sufficient information. The Police say the FIR is not necessary

2) The dealer says that they need to change the entire rear door but they dont have the part in stock and have advised me to come after 20 days, but have told me I can use the vehicle in the meantime. Is this fine ?

3) If I claim insurance, will my insurance company claim from the person who hit my vehicle since I have all the particulars.

4) Is it posssible for the car to be as good as new -  There is significant body damage but does not appear to be structural damage.

Appreciate the help of fellow carwale members with this

1. FIR is not necessary if the accident is minor, so dont know how serious and how expensive the repair is. While some insurance cos. do not ask for FIR copy in minor accidents, some require it mandatorily. So, contact your insurance company, also you have to inform them of the claim.

2. This again depends upon the extent of damage. If the car is in driveable condition, and you wish to do so, you can drive it along. But if there are problems with it, dont drive the car.

3. That is again a company policy. And in this case, I dont think so. Even if they do, it will be between your insurance co and the other insurance company. Do not worry about that. 

4. Yes. Provided the rear fender and door are replaced and repainted, the car will be good as new. As long as the structure, ie chassis, engine bay etc are not tinkered, you will not notice any difference.

1) There is extensive damage to the rear door and rear side fender, but the damage is mainly to the bodywork and there does not appear to be any structural damage. If damage to the body (denting and replacement of the rear door) is considered minor I probably do not need an FIR. I went to the dealer an their accident surveyor looked at the damage but did not ask me to fill any form or to contact the insurance company myself. He said they will undertake all formalities when I bring the car in for repairs once the required parts come into their stock (will take around 20 days) . Should I be insisting that they fill the accident repair form right now instead of waiting and losing precious time and should I proactively be contacting the insurance company myself instead of waiting for the dealer to do it.

2) The car is totally driveable except for the aesthetics Cry and they have told me to go ahead and use it. I would prefer to do this rather than letting the vehicle rot in the workshop waiting for the parts to arrive.

3) My only concern is that I am not penealized with higher premiums etc through no fault of my own if I can provide the insurance company with the registration details/address of the driver that hit me so that they can claim from his third party insurance.

4) Thats good news because I would like to preserve the vehicle intergrity as far as possible.

Once again thank you for taking time out to answer my queries and if you have any tips/hints or any suggestions on what I should be doing between accident date (31st July)  and 20 days later because I do not want to weaken my claim by not taking any form of action for 20 days.

Parthai, waiting to hear the rest of the insurance part ? been a long time already.

BTW, i have a big dent on the left rear bumper and a visible dent on the right door near the car handle.

experts , pls advise on whether to show this as an accident or my own negligible driving to the Insurance surveyor. I heard from my friend and here in the forum, it may require a FIR

Well as dicsussed in my previous post I made out a report about the particulars of the accident along with some photos and took it to the dealer. I asked them to sign it but they did not giving some administrative reason. I left my documents such as RC Insurance and my DL for the surveyor to see along with the vehicle. I did not face any complications and the repairs were carried out to my satisfaction. There is no need for an FIR if the damage is not too expensive. You probably need to explain how and why the damage occured.

   You have to mandatorily pay around 1000 Rs while insurance takes care of the rest, however by making  a claim you lose the no claim bonus, so if it is cheaper to repair the damage by yourself I would say go for that. My Nano too was dented on the front fender and insurance did not cover that, but the cost to repair was around 1000 Rs so I got it fixed by paying for it.
